• Should Twerking Be Considered A Sexual Offense?

    In New York, indecent exposure is considered a sex crime. Should twerking carry the same shameful distinction?

    Under New York Penal Law § 245.01, a person is guilty of indecent exposure if he or she appears in a public place and exposes his or her unclothed private parts. It’s a Class “B” Misdemeanor and being charged with indecent exposure can result in up to 90 days in jail, probation, conditional discharge (with conditions imposed by the court, such as community service or completion of a treatment program), and fines. The reason for categorizing exposure of a private part as a sex crime is because it’s eye rape. It can be embarrassing, exploitative, and scarring to the viewers, adults and certainly children.

    There are two carve outs for public exposure. Breastfeeding of infants and any person entertaining or performing in a play, exhibition, show or entertainment. Regarding the second category, this is likely because customers know what they’re getting and have agreed to the terms.

    Why does public and random twerking not carry the same gravitas as indecent exposure? Twerking is defined by Mariam-Webster dictionary as “sexually suggestive dancing characterized by rapid, repeated hip thrusts and shaking of the buttocks especially while squatting.” The graphic nature is the entire point of the movement.

    A video has gone viral of a man in military uniform twerking. It showed up on my Twitter feed. I don’t follow him, didn’t ask to see this, and I feel violated. I don’t want to see his large buttocks gyrating in my face.

    Twerking has become pervasive in America and it coincides with America’s degeneracy - there is an absolute correlation. How could there not be? Again, when sexually charged movements are made in public, it’s a violation of others’ personal space and emotional well-being. As mental health is a constant conversation now, it’s time to address twerking.

    A teacher was arrested for “twerking on an underaged student.” The student told investigators that while he was on the dance floor, Hoover [the teacher] ‘twerk[ed] on him’, making him feel uncomfortable. He wasn’t the only one; at least two other people tried to get the teacher to stop, going so far as to get in between the two.” Nurses are filming themselves twerking in hospitals, with their hands placed on their rear ends. And mothers are twerking on their own children, despite the children’s abject mortification.
