• Nevada State Supreme Court Defies 5th Circuit Ballot Ruling

    In a new election development, the Supreme Court of Nevada has ruled that ballots received with a postmark 3 days after the November 5 election may be counted.

    The ruling comes after the 5th Circuit Court of Appeals--a federal court with a jurisdiction of Louisiana, Mississippi, and Texas--ruled that ballots in those states must be received by election day.

    While federal law supersedes state law, in this case not directly via jurisdiction, but by precedent, it remains to be seen whether higher courts--potentially the Supreme Court of the United States--will intervene.

    Nevada is part of the 9th Circuit, composed of California, Nevada, and Oregon, was for a long time a very liberal circuit. The presidency of Donald Trump changed the makeup of the court, however, as he appointed 12 conservative judges to what Rush Limbaugh used to call the "Ninth Circus".
