A lawsuit in New Jersey this week claims Meta cheated on immigration forms to secure visas and green cards for Chinese staff, and fired an employee after he refused to participate.

The lawsuit concerns James Tillinghast, a former employee who claims he was fired after he refused to sign a fraudulent report. Tillinghast claims a letter drafted by immigration attorneys at Meta claimed that an employee, Shenxun Wang, contributed $638 million of advertising revenue to Meta. Tillinghast claims he had no way of supporting this claim.

The letter was drafted to support an EB-2 National Interest Waiver. Under this waiver, a company has to claim that a foreign employee provides value to the company and the hiring of said employee is of national interest. Tillinghast claims the draft letter claimed that Wang made important contributions to Meta's algorithms and that he was Wang's direct report.

Tillinghast claims he removed all the fabrications in the letter. Meta's management claimed that the letter of national interest was completed by someone else, and was then signed by a different manager. Tillinghast was then terminated. He is now seeking $1 million in losses, including lost earnings of $565,000, loss of unit awards of $490,000, and punitive damages.

The Trump administration's campaign against corporate visa abuse is happening as this lawsuit lands. In August, Anthony D'Esposito, the Labor Department's Inspector General, cited a common practice inside major corporations: managers using the visa system as a private patronage network — selling jobs to co-nationals in exchange for kickbacks and favors at the direct expense of American workers.

Just weeks earlier, the DOJ fined OpenAI $3.2 million after the AI company failed to follow proper advertisement requirements for a position being filled by a visa holder. Assistant Attorney General for the Civil Rights Division, Harmeet K. Dhillon, was direct: "It is illegal to discriminate against U.S. workers by preferring temporary visa holders for jobs."

Former Meta software engineer Jeremy Bernier summed up what he witnessed firsthand: "At Meta, 90% of my coworkers were Chinese, and non-Chinese were routinely excluded, disadvantaged, and targeted for layoffs." He says the pattern was deliberate — not accidental.

What the Meta lawsuit exposes is something Silicon Valley has known for years: the H-1B and green card systems have been quietly weaponized by ethnic enclaves inside major tech companies to displace American workers. The legal machinery meant to protect American jobs is being falsified, circumvented, and rubber-stamped by corporate lawyers who operated for years without consequence.

The Trump DOJ is now watching. Whether Big Tech's money and lobbying can slow the reckoning remains to be seen. But Zuckerberg's Meta may be about to find out what happens when you treat American workers as an obstacle — and put foreign patronage first.
